If during the validity period of the waybill a vehicle is used by several drivers in shifts, then several waybills can be issued for each driver for one car.

The required detail “Transportation Details” has been added to the waybill. It must indicate the type of message and type of transportation from Art. 4 and 5 of the Federal Law of November 8, 2007 No. 259-FZ.

There are only three types of transportation: regular, by order and by passenger taxi. There are five types of messages, these include:

  1. Transportation of passengers, luggage and cargo in urban, suburban, intercity and international traffic.
  2. Transportation in urban traffic within the boundaries of populated areas.
  3. Suburban transportation between populated areas at a distance of up to 50 km between the borders of these populated areas.
  4. Suburban transportation between populated areas at a distance of more than 50 km between the borders of these populated areas.
  5. Transportation in international traffic outside the Russian Federation or into the territory of the Russian Federation crossing the State border, including transit through Russia.

The new rules indicate that the official responsible for the technical condition and operation of transport is responsible for monitoring the technical condition. Now it is indicated that this is done by the technical condition controller. If everything is in order, you need to put o.

A waybill (WW) is an important accounting document that accompanies the operation of any company vehicle - cars, trucks, passengers. It records all information related to the operation of the car:

  • vehicle model and number;
  • Driver's name and hours of work;
  • odometer readings at the beginning and end of the work shift;
  • vehicle mileage, recording of crossings and work performed;
  • fuel consumption, etc.

Based on the above information, the accountant of the company or individual entrepreneur not only monitors the use of the vehicle and the efficiency of the driver, but also calculates the salaries of the driver, mechanic and dispatcher. The preparation of PLs and keeping records of their issuance are usually carried out by the head of the department, accountant, dispatcher or other appointed person.

The waybill is issued (clause 2, 9 of the Mandatory details and the procedure for filling out waybills):

• for one day, if the driver makes one or more trips during a shift (working day) within one day. In this case, indicate the date (day, month, year);

• for a period corresponding to the duration of the flight, if it exceeds the duration of a shift (working day), or for a period corresponding to the number of calendar days to which a shift (working day) falls on more than one calendar day. In the waybill, indicate the dates (day, month, year) of the start and end of the flight.

Include the following information in the information about the owner (possessor) of the vehicle, who is a legal entity (clause 3 of the Required Details and Procedure for Completing Waybills):

• Name;

• organizational and legal form;

• location;

• phone number;

• OGRN.

Waybill for vehicles

This is a document for primary accounting that confirms:

  • fact of vehicle movement;
  • vehicle and fuel maintenance costs;
  • the fact that the car is in good condition;
  • ownership rights of an organization or individual entrepreneur to a car;
  • the driver's right to drive this vehicle.

Consequently, the question of whether a health worker’s note is required on the waybill is resolved by itself. If the document is to confirm whether the driver is allowed to drive, then the medical worker’s mark on the waybill for the passenger car, as well as all other types of transport, is required.

A budget organization can independently develop a form based on the specifics of its activity. Or use unified forms for types of vehicles, approved by State Statistics Committee Resolution No. 78 dated November 28, 1997. Vouchers should be kept in a special registration journal (using Form 8 or developed independently). Companies must store primary records and information logs for at least 5 years (clause 18 of section III of Order of the Ministry of Transport of Russia dated September 18, 2008 No. 152).

Is a medical examination required on the travel document?

There are two types of medical examination of the driver: pre-trip (carried out immediately before departure on a trip) and post-trip (carried out after the end of the trip or completion of the task).

A pre-trip medical examination is mandatory for all budgetary institutions that operate transport, but a post-trip medical examination is required for transport companies and organizations involved in the road transport of passengers and dangerous goods. The need for a medical examination of the driver of the institution is prescribed in paragraph 1 of Art. 20 of the law of December 10, 1995 No. 196-FZ.

If you look at the waybill, the health worker’s mark is affixed in the following order:

  1. The date and time of the medical examination of the driver is indicated.
  2. Conclusion from a doctor or paramedic about the driver’s health condition.
  3. Signature and transcript of the health worker’s signature.
  4. Sample of a medical worker's stamp on a waybill. If the examination is carried out by a staff doctor of the institution, then it is not necessary to put a stamp.

Some institutions that do not have the opportunity to maintain a physician on staff transfer these powers to a full-time employee who does not have a professional medical education. For example, they are charged with labor duties to the head of the transport department or a personnel officer. This situation is a direct violation of the law. To avoid fines from regulatory authorities, enter into an agreement with a medical organization or hire a part-time health worker.

According to the new rules, a waybill must be filled out for any vehicle used by a company or individual entrepreneur. That is, from the old rules they removed the clause according to which a waybill is issued when operating a car only when transporting passengers or cargo.

It turns out that in 2021 you will have to issue a waybill, even if the car is without passengers. But there is one discrepancy here. Article 6 of Law No. 259-FZ dated November 8, 2007 states that waybills are required only for the transportation of passengers and cargo. It turns out that the provisions of the new order contradict the Law of November 8, 2007 No. 259-FZ. So far the Ministry of Transport has not commented on this point.

A new detail has appeared in the waybill - “Information about transportation”. It reflects information about the types of messages and types of transportation.

For example, the type of communication is suburban, intercity, international communication, and the type of transportation is regular passenger, transportation by order, etc. (Articles 4 and 5 of the Law of November 8, 2007 No. 259-FZ). In 2021, companies and individual entrepreneurs do not indicate such details on the sheets.

Voucher without a doctor's note

A document filled out according to the established rules, but without a mark and stamp indicating a completed medical examination, is considered valid. When conducting an on-site or desk audit, tax officials recognize the travel expenses incurred for such a voucher. But the traffic police officers will fine you (comment in part 2 of article 12.31.1 of the Code of Administrative Offenses of the Russian Federation):

  • driver - 3,000 rubles;
  • manager or head of the transport department - 5,000 rubles;
  • legal entity - 30,000 rubles.

If a budget organization uses a false stamp to confirm a driver’s medical examination or illegally violates the established procedure, Article 11.32 of the Code of Administrative Offenses provides for fines:

  • per driver - from 1000 to 1500 rubles;
  • for the manager or responsible person who allowed the use of a false stamp - from 2000 to 3000 rubles;
  • for organization - from 30,000 to 50,000 rubles.

Penalty for lack of pre-trip inspection

The fine for the absence of a pre-trip or post-trip medical examination is provided for in Part 2 of Article 12.31 1 of the Administrative Code:

2. Carrying out transportation of passengers and baggage, cargo by road transport and urban ground electric transport in violation of the requirements for pre-trip and post-trip medical examinations of vehicle drivers -

entails the imposition of an administrative fine on citizens in the amount of three thousand rubles; for officials - five thousand rubles; for legal entities - thirty thousand rubles. . Note. For administrative offenses provided for in this article, persons carrying out entrepreneurial activities without forming a legal entity bear administrative liability as legal entities.

The fine for not having completed a pre-trip medical examination will be:

  • 3,000 rubles for the driver;
  • 5,000 rubles for the employee responsible for releasing vehicles for travel;
  • 30,000 rubles for an organization (in this case we are talking not only about legal entities, but also about individual entrepreneurs).

Waybill for a week, how to arrange a medical examination

The organization has the right to issue vouchers not every day, but for example, for a week or several days. But no more than one month. Let’s look at how to deal with medical examinations in such a situation using a specific example.

Let's say a driver is sent on a long business trip for two weeks. Before leaving for a flight, he undergoes a medical examination in accordance with the established procedure. On the issued voucher, the doctor issues the appropriate visa that the employee is allowed to drive transport. Upon return, the driver undergoes a post-trip examination, about which the doctor makes a corresponding note. Such a document gives the driver full right to make long business trips (Determination of the Supreme Arbitration Court of the Russian Federation dated June 30, 2009 No. VAS-7619/09, Resolution of the Supreme Court of the Russian Federation dated October 5, 2012 No. 46-AD12-18, Samara Regional Court dated April 29, 2013 No. 4a-231 /2013).

Therefore, on a long flight, when the ticket is issued for several days, it is enough to undergo inspection before departure and upon return. No additional surveys or examinations are required along the way. However, the management of the organization may provide for a medical examination at the place of arrival by concluding an appropriate agreement with the receiving party for the provision of medical services. Thus, the driver will undergo four inspections: one before departure, the second upon arrival at the destination, the third upon departure and the fourth upon return to the main place of work.

Please note that this algorithm is not required. Two inspections are sufficient: before departure on a business trip and upon arrival.

Mechanic's mark on the waybill

The order of the Ministry of Transport of Russia established another mandatory requirement - a mechanic’s mark on the serviceability of the vehicle. After the technical inspection of the vehicle, the responsible employee makes a note on the ticket that the car is in good working order, then indicates the date (DD.MM.YYYY) and time (hours and minutes) of the inspection, certifies with his signature and transcript.

Without a mechanic's report on the condition of the vehicle, traffic police officers will punish you by issuing a fine. Federal Tax Service employees take a neutral position on this violation, recognizing the violation as insignificant.

This article will discuss the changes that are being made to the order of the Ministry of Transport of the Russian Federation “On approval of mandatory details and the procedure for filling out waybills” from March 1, 2021.

I would like to note right away that there are few innovations and they are small. However, if your organization issues waybills, then the changes should be taken into account in your work.

Conducting mandatory medical examinations

Mandatory pre-trip and post-trip medical examinations of vehicle drivers are carried out either by hired medical workers, or in the manner and under the conditions provided for in Part 4 of Article 24 of the Federal Law of November 21, 2011 N 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation.”

4. In order to protect health, employers have the right to hire medical workers and create units (doctor’s office, health center, medical office, medical unit and other units) that provide medical care to the organization’s employees. The procedure for organizing the activities of such units and medical workers is established by the authorized federal executive body.

There are 2 options for conducting pre-trip and post-trip medical examinations:

  • Hire a medical professional on staff. This option is suitable for large organizations.
  • Involve health workers working in other institutions. This option is suitable for small companies.

In any case, medical examinations are carried out at the expense of the employer:

Canceling stamps

Mention of stamps is completely excluded from the procedure for filling out waybills:

Dates, times and odometer readings when a vehicle leaves the parking lot and enters the parking lot are entered by authorized persons appointed by the decision of the head of the enterprise or individual entrepreneur, and certified by their signatures indicating last names and initials, with the exception of cases where the individual entrepreneur combines the duties of a driver.

16. The dates and times of the pre-trip and post-trip medical examination of the driver are entered by the medical worker who conducted the relevant examination and certified by his signature indicating the surname and initials.

Until March 1, 2021, stamps could be placed by officials to certify the time and odometer readings when entering or leaving a parking lot, and also had to be placed when conducting a medical examination of the driver.

Starting from March 1, 2021, the word stamp is completely excluded from the order of the Ministry of Transport. Now all transactions must be certified only by signatures .

In addition, the medical worker now puts the surname and initials on the waybill, whereas previously it was required to write the full name and patronymic.

Order on approval of the waybill in 2021

About the vehicle, enter the following information (clause 4 of the Mandatory details and the procedure for filling out waybills):

• type, make and model of the vehicle, and if it is used with a trailer (semi-trailer), also the make and model of the trailer (semi-trailer);

• state registration number of the vehicle, and if it is used with a trailer (semi-trailer) - its registration number and (or) inventory number (for trolleybuses and trams);

• odometer readings (full kilometers driven) when leaving the parking lot intended for parking the vehicle upon returning from a trip and the end of the driver’s shift (working day), as well as when he enters the parking lot at the end of the shift (working day);

• date (day, month, year) and time (hours, minutes) of pre-trip or pre-shift monitoring of the technical condition of the vehicle (if mandatory monitoring is provided for by the legislation of the Russian Federation);

• date (day, month, year) and time (hours, minutes) of the release of the vehicle onto the line and its return.

Information about the driver who will carry out the flight must include (clause 5 of the Mandatory details and the procedure for filling out waybills):

• last name, first name, patronymic of the driver;

• date (day, month, year) and time (hours, minutes) of the pre-trip and post-trip medical examination of the driver (if the mandatory post-trip medical examination of the driver is provided for by the legislation of the Russian Federation).

Fill out the waybill for a passenger car taking into account the general rules of registration. You can take Form No. 3 as the basis for your form, supplementing it with all the missing required details.

In the route, indicate all the points the car will travel to. Reflect the fuel consumption in full, based on the indicators of the devices.

Fill out the truck waybill taking into account the general rules of registration. You can take form N 4-C or form N 4-P as the basis for your form, supplementing it with all the missing required details.

Depending on the driver’s remuneration conditions, the following will be suitable:

• at piece rates - modified form N 4-C;

• at a time tariff - supplemented form N 4-P.

Fill out the waybill and hand it over against signature. Some of the data will be filled out by the customer, for example, tear-off coupons. Issue a new waybill only after the driver has handed in the previous one.

If you are transporting material assets, enter the details of the shipping documents into the waybill, which indicate the characteristics of the cargo being transported.

Keep waybills and shipping documents together.

  2. There are no fields for the medical worker to mark the driver’s pre-trip and post-trip medical examination. They should be added. When using the Goskomstat form, the seals are placed in the header, where there is some free space.

The dates and times of the pre-trip and post-trip medical examination of the driver are indicated by the medical worker who conducted the relevant examination and certified by his signature indicating the surname and initials. Based on the results of the pre-trip medical examination, the following information is indicated on the waybill. Based on the results of the post-trip medical examination, the o.

  1. The information entered by the mechanic during the technical inspection of the vehicle is available, but the inspector must release the equipment onto the line. This is an official who can be the same auto mechanic, but with qualifications in accordance with the requirements of Order No. 287, paragraph 14.
  2. There is no field for entering the date and time of the technical inspection (before and after the flight or shift). And this is a required attribute. Just for its absence they can be fined 30 thousand rubles (from judicial practice).
  3. There is no option to enter odometer readings. There is a speedometer, but this is no longer relevant. Odometer information is entered into this field, although these are different values. When creating your own form, correct the error.

Note: In connection with the introduction of remote technologies for conducting a pre-trip (pre-shift) medical examination, instead of a medical worker’s stamp, you can either make an entry similar to the mark of the vehicle technical control controller, or provide a place for pasting a sticky sticker - the driver’s access to driving a vehicle, certified by the UKECP.

  • date and time of the pre-trip and post-trip (if provided for by the legislation of the Russian Federation) medical examination of the driver.

6. Shipping information

  • include information about types of messages and types of transportation.

Note: Additional details may be placed on the waybill, taking into account the specifics of activities related to the transportation of goods, passengers and luggage by road.

First of all, a primary reporting document is necessary for transport organizations to write off funds for fuel and lubricants and pay salaries to employees. In addition, it reflects important information about:

  • driver operating mode;
  • types of transportation;
  • travel route;
  • employee health;
  • technical condition of vehicles;
  • revenue when paying for travel;
  • fuel consumption;
  • customer, if any;

If it is necessary to keep logs, where some of the information is duplicated, regulatory authorities verify the information with the data on the waybill. Thanks to them, the activities of the transport company are confirmed (the intended use of vehicles), the reality of pre-trip (post-trip) control, the accounting of funds in the accounting department, and much more. etc.

Drivers and individual entrepreneurs whose activities do not include accounting for fuel consumption are often asked about the need to issue a voucher. This p/l does not affect tax deductions in any way. Why fill it out if no one needs the information you enter?

This is wrong. The target legality of transport management must be documented. According to the Laws of the Russian Federation, organizations, legal entities and individuals (individual entrepreneurs, self-employed) operating vehicles are required to have a travel document for:

  • transportation of passengers, including own employees (directors);
  • movement of goods, both for commercial and personal purposes.

The voucher, in addition to the listed data, carries information about the driver’s health condition, the condition of the car, serving to ensure road safety. The primary purpose of P/L is to reduce the level of road accidents by monitoring the work of carriers.

Note: In the absence of a trip, in the event of an accident, insurance compensation for damage will be denied, since the legal validity of being on the flight has not been confirmed. When transportation concerns taxi drivers, the car can be taken to the impound lot, depriving them of the opportunity to earn money.

Maximum validity period of a waybill

Well, the most serious change affected the validity of the waybill:

If a car performs one or several flights during the day, then, as before, it needs one waybill per day.

If the duration of the flight exceeds 1 day, then the waybill is issued for the entire flight.

On the one hand, the mention of a period of 1 month is excluded from the order, that is, from March 1, 2021, waybills can be issued for a longer period :

For example, if a car makes a long trip across the country and returns to its permanent parking place only after 6 weeks, then one waybill is enough for it.

On the other hand, before March 1, 2021, it was possible to issue a waybill for a month and make several flights during this month:

For example, a waybill was issued for a month and during this month the car was returned to the organization many times, i.e. performed several dozen flights.

For example, every 2 days there was a new flight, and the car transported goods to a neighboring city and returned back.

From March 1, 2021, this option is not possible and a separate waybill must be issued for each flight.

There are inconsistencies in regulatory documents on this issue. The article examines the Order of the Ministry of Transport, from which stamps have already been excluded. However, there is also an order from the Ministry of Health and another order from the Ministry of Transport, which have not yet been updated. They still have the requirement for stamps.

In any case, if you continue to put stamps as before, this will not be a violation.
