How to write a certificate from a parent’s work for a child care institution

Often employees require a certificate from their place of employment, which is a document that is of an informational nature. The purposes of employee applications for certificates may vary. A certificate from the place of employment is confirmation of the fact that the subject who received the certificate is actually employed in the named organization and occupies a certain position, which means that the employee has a certain income (which will be indicated by the additionally requested 2-NDFL certificate). Let's consider the procedure for generating a certificate of employment.

Why is it needed?

Cases when a certificate from a parent’s place of work is required for a kindergarten are varied:

  • when applying for a passport or visa;
  • to the MFC to reimburse the costs of a children's camp;
  • to obtain a loan;
  • to pay for sick leave;
  • when participating in legal proceedings;
  • for calculating benefits;
  • to confirm that the parent is working during the period of general self-isolation - a certificate for the kindergarten stating that the parent is working is the basis for admitting the child to the duty group.

How to get

To obtain the document, the employee submits a written application addressed to the general director of the company (see Article 62 of the Labor Code of the Russian Federation). The request indicates what information the certificate of employment for the kindergarten should contain. It is better to take a sample from the institution where the paper is being submitted and take it to work so that you do not have to redo the document.

The employee is not required to specify the place of the request or the purpose of his request. The application is sent to a specialist in the human resources department, an accountant, or sent by mail. If the employee does not show up for the completed work document, it is sent by registered mail to the address specified in the application.

Who issues

It depends on the information that the document is intended to confirm. Most often, a paper containing a certified extract from the work record book is issued in the human resources department, including a certificate from work for a kindergarten stating that parents are working during the period of self-isolation. The document is signed by the head of the enterprise or an authorized employee by power of attorney.

Any information about wages is requested from the accounting department. If a certificate from an employer for a kindergarten reflects information about income, it is signed by the director and chief accountant.

The completed document is handed over personally to the employee or another person acting by proxy. An employer has no right to give a document about work activity to a stranger; this violates Federal Law No. 152-FZ of July 27, 2006 “On the Protection of Personal Data.”

An individual entrepreneur makes a document for himself. Such papers are usually accompanied by an extract from the Unified State Register of Individual Entrepreneurs or a copy of the registration certificate. The individual entrepreneur confirms his income using a certified copy of the tax return for the previous period or 3-NDFL.

Is it worth issuing a certificate using the bank form?

This decision remains with the borrower. He can neglect 2-personal income tax, especially if he works with a “gray” salary, and still get a loan. But in such a situation, it is important to carefully calculate the risks. Remember that in the event of unforeseen circumstances, a person with a “gray” income is less protected than a person whose income is completely transparent. And financial insecurity can cause loan delays and debt. In addition, banks, realizing this, seek to protect themselves - the interest rate for borrowers who have not provided 2-NDFL is usually higher. Evaluate all the conditions and factors before taking out a loan, and if possible, try to work with a “white” salary. However, for successful lending, at least a year must pass from the moment of employment - this is also worth taking into account.

Design rules

In labor legislation, there is no unified form for a certificate for a kindergarten stating that parents are working; the organization must independently develop and approve a form that includes the following mandatory information:

  • Name of the organization;
  • date of compilation and serial number;
  • Full name of the employee, since when he has been working;
  • position held and salary;
  • signature of the company director.

Applications in the form of copies are indicated as a separate item.

What to do for those who work informally

There are people who do not draw up an employment contract at all and do not make entries in the Labor Code. These are freelancers, outsourced specialists, and other employees. If such a person does not pay taxes, he is officially not connected with the employer at all - which means he cannot even provide a certificate in the form of a bank. If such a person needs to get a loan, he can go one of three ways.

Find a suitable offer

One for which proof of income is not required. These are mainly loans for a small amount and for a short period, as well as credit cards. Apply for self-employment

But this method of confirming reliability has a number of disadvantages and features - they should be taken into account even before taking out a loan. Please note: the larger the amount you need to borrow and the more complex the conditions, the more strictly the bank will evaluate the borrower’s financial situation. This is especially true for mortgages and car loans: they are issued for large amounts and for a long period of time, which means that in connection with such loans the bank bears more risks. Advantages

The main advantage is the ability to confirm solvency, even without being officially employed. The document will be seen only by bank representatives; it is protected by bank secrecy and is not available to third parties. True, there is information that the state is going to expand the Federal Tax Service’s access to information protected by bank secrecy, but so far this practice has not been implemented. It may not matter to a credit institution whether the employee’s employer pays taxes - in this case, the terms of the loan will not change if the person provides a certificate in the bank’s form. But this doesn't always happen.

Flaws

Unfortunately, this approach has more disadvantages than advantages. Many employers are reluctant to issue income certificates in the bank form: this is indirect evidence that they pay salaries according to a “gray scheme”, and companies do not want to take risks. In addition, some banks consider unofficial registration a source of increased risk. There are reasons for this opinion: it is easier for such an employee to be fired without payments, and he is more vulnerable to loss of funds than an officially employed one. Therefore, if a person provides a certificate in the form of a bank, the creditor can:

  • increase the interest rate by 1–6%;
  • reduce the loan amount;
  • refuse a loan;
  • request additional evidence of income.

Additional evidence may include a foreign passport with notes on foreign trips, documents for real estate or a car owned and other indirect evidence of material well-being.

Can an employer refuse

No, this is illegal and threatens the employer with an administrative fine of 30,000 to 50,000 rubles. (Articles 5.27 and 5.39 of the Code of Administrative Offenses of the Russian Federation).

A worker has the right to request and receive information about his work activities at the enterprise. Upon a written request from an employee, the company is obliged to issue official documents reflecting:

  • information about hiring;
  • job title;
  • salary size;
  • schedule;
  • experience, etc.

The company has three working days to prepare information: a certified copy of the work book, proof of income, etc. If the employee refuses to provide supporting information, he has the right to go to court.

Can a former employee apply?

It is enough for a former employee to send a written request to the employer to confirm data on his work activity: information about cash payments, copies of documents, extracts. The preparation period is three working days. Most often, they contact their previous place of work to obtain a certificate in Form 182-N. It is issued so that the new employer correctly calculates sick leave or maternity benefits. Data is entered starting from the first cell, without protruding beyond its boundaries. There are 29 cells in the form to fill out this line.
If there are not enough cells, then the organization has the right to approve, by order of the head, a special abbreviated name used to write such a name only for certificates of incapacity for work. In this case, the FSS of the Russian Federation will identify the organization by its registration number, also indicated on the sick leave.

Quotation marks, periods, commas, dashes, and number signs are not used in the name of the organization , but spaces between words are required. However, the presence of such signs is not prohibited and they are placed in separate cells.

The name of the organization is the name of the legal entity established in the constituent documents, containing an indication of its organizational and legal form (for example, LLC, JSC, HOA, etc.). The constituent documents also provide for the abbreviated name of the organization.

The line “(place of work - name of organization)” is present in the form of a certificate of incapacity for work in two sections:

  1. In the section “to be filled in by a doctor of a medical organization”, the specified line is filled in by the doctor issuing the sick leave. The data is indicated from the words of the sick employee.
  2. In the “to be filled in by the employer” section, this line is filled in accordingly by the employer’s employee.
