Minimum wage in the Kemerovo region and Kemerovo from January 1, 2021, taking into account the regional coefficient

Minimum wage in the Kemerovo region and Kemerovo for 2021 - what it will be

The state guarantee in the form of establishing a certain legislative minimum wage or minimum wage is provided directly by the Constitution of the Russian Federation. This means that every employer is obliged to pay wages upon concluding an employment contract in amounts no less than those provided for by the relevant laws and regulations.

From the point of view of legislation, there are now two types of minimum wages: the federal minimum wage, which operates throughout the Russian Federation as the basic unconditional level of the minimum wage, as well as regional minimum wages. The regional minimum wage is established directly on the territory of a separate subject of the federation by concluding a special tripartite agreement between representatives of workers, employers and local authorities of the region. At the same time, the regional minimum wage may provide for its own terms of payment and the ability of enterprises to refuse to use it.

The requirements of federal legislation are paramount if the regional minimum wage is lower than the federal one. In other cases, most employers are required to use remuneration standards established at the regional level, with the exception of certain situations.

The Kemerovo region has its own separate regional agreement on the minimum wage. That is why many workers and employers are interested in all the features and nuances of what the minimum wage will look like for 2021 in Kemerovo and the Kemerovo region, taking this factor into account. Thus, from January 1, 2021, the federal minimum wage will be 12,130 rubles - 850 rubles more than in 2021. Indicators at the federal level are also important for some categories of workers in the Kemerovo region. In relation to workers of public utilities, budgetary institutions, as well as the spheres of transport and communications, it is the federal indicator that is mandatory for use.

The regional minimum wage indicator, in accordance with the requirements of the tripartite regional agreement, is equal to the subsistence minimum in the region, multiplied by a factor of 1.5. Thus, the size of the regional minimum wage as of January 1, 2021 in Kemerovo and the region is:

  • 12,130 rubles - for employees of budgetary institutions, as well as communications, transport and utilities.
  • 16516.5 rubles - for other categories of workers.

However, there is another factor that affects wages in Kemerovo and the region. This is a special regional coefficient, which is designed to compensate for the unfavorable environmental and climatic situation in the region and provide additional social guarantees to all workers in the region. This coefficient is equal to 1.3 and applies to all salaries without exception. So the actual minimum wage for 2021 in the Kemerovo region, taking into account the regional coefficient, is higher and is, accordingly:

  • 15,769 rubles - for employees of budgetary institutions, transport, communications and utilities.
  • 21,471.75 rubles - for employees in other business entities.

All this makes labor in the Kemerovo region one of the highest paid in the Russian Federation, at least in terms of minimum wages. As for workers whose salaries are higher than these indicators, increasing the minimum wage in Kemerovo in 2021 will not bring any changes.

Basic minimum wage value

  • The minimum wage in the Kemerovo region 2021 for public sector workers is equal to the federal one - 11,280 rubles. For the first time, the amount was equal to the subsistence level of the working population in the country.
  • The minimum income of Kemerovo private sector employees is slightly higher. In 2020, the cost of living was approved at 9,925 rubles. When multiplied by one and a half times the minimum wage in the Kemerovo region for 2020 for commercial organizations is 14,887.50 rubles.

Even before taking into account the regional coefficient, the amount seems too high to employers. Small businesses are not always able to pay wages above the standard minimum wage. Because of this, they plan to amend the legislative act to relieve small businesses. It is not known how this will be implemented; perhaps the regional authorities will take on part of the payments.

In the context of certain types of work activity, for example, when working in harmful or dangerous conditions, the actual minimum wage may be at the expense of other regulations.

About the minimum wage in the region

Minimum wage is the amount of the minimum monetary remuneration that an employer must pay to an employee employed on a full-time basis and with full-time hours worked. The amount of the minimum wage is established by the Government of the Russian Federation and cannot be lower than the subsistence level (LM), as stated in Art. 133 Labor Code of the Russian Federation. This is quite logical, because it is basically impossible to live without receiving the PM amount. The PM is also established by the Government of the Russian Federation after receiving a report on the standard of living of the population from Rosstat.

It is worth knowing that an employee may be given an amount less than the minimum wage, because personal income tax will be deducted in the amount of 13%. For violation of wage rates, the employer will be brought to administrative or criminal liability.

In the Kemerovo region, the minimum wage differs from the minimum wage and is “tied” to the regional minimum wage. The PM is calculated by the territorial Rosstat and submitted to the Governor of the region. After the approval of the new monthly minimum wage, the tripartite commission begins to consider the issue of increasing minimum wages in various industries to the monthly minimum wage level.

The commission operates in accordance with the Law of February 21, 2003 No. 7-OZ “On tripartite commissions for regulating social and labor relations.” There are 7 people from each side. The decision is made by the consent of all parties. According to the regional Law of June 23, 2003 No. 33-OZ “On legislative activity in the Kemerovo region”, the Agreement is published in the Kuzbass newspaper and in the bulletin of deputies of the Kemerovo region.

Will public sector employees' salaries be increased in 2021?

Already at the beginning of 2021, it was clear that the salaries of public sector workers, despite annual salary increases, did not reach the planned levels. The growth of the minimum wage and average wages of Russians outpaced the planned indicators of the program for the gradual improvement of wages in state (municipal) institutions in 2012–2018.

From January 2021, public sector employees will receive 6% more. The salaries of teachers, doctors, scientists and social workers - everyone who was discussed in the May presidential decrees - will increase. Since 2012, salaries of public sector employees have been regularly increased, but even in 2019 they will not reach the planned levels of 100 and 200% of the average income in the regions.

Minimum wage for 2020 in Kemerovo and the region - features and nuances

First of all, it is necessary to understand that the previously available practice of accounting for the minimum wage after the application of the regional coefficient since 2017 is considered illegal. Thus, it is now believed that the salary should correspond to the minimum wage even before coefficients are calculated on it, and not after that.

It is also necessary to understand that the regional agreement, which sets the minimum wage in the Kemerovo region for 2021, involves linking this indicator to the cost of living, which can and will change throughout the year, so employers may need to adjust the salaries of their employees even after beginning of the year.

Every employer in the Kemerovo region has the right to refuse to participate in a tripartite agreement - he has time to do this within 30 days after registering an enterprise or starting to do business in the Kemerovo region. To refuse, he must be given a supported explanation as to why he cannot pay wages in accordance with the regional minimum wage. If the employer refuses to participate in the tripartite agreement, it will only be obligated to pay a salary not lower than the federal minimum with a regional coefficient.

In some cases, employers have the right to pay wages below the minimum wage. For example, if an employee works part-time, in such a situation his minimum earnings may be reduced in proportion to the minimum wage and the actual time worked. The same applies to situations where the employee did not fully perform his job duties or was absent from the workplace.

The federal minimum wage and the regional coefficient also influence not only the actual wages of workers. In addition, a change in the federal minimum wage entails a change in the amount of minimum sick leave benefits, as well as maternity payments, which should be kept in mind by both workers and their employers.

BUT, since organizations on the budget pay the minimum wage at the federal level, they cannot reduce this figure under any circumstances. The same goes for not using the coefficient.

  • the maximum temporary disability benefit from 2021 for those employees whose work experience is less than 6 months (or when there are grounds for reducing the amount of the benefit), calculated for a full calendar month cannot exceed the minimum wage for 2021 in Russia (taking into account regional coefficients to salary, if they are established). For example, in January 2021, the maximum daily benefit will be 391.29 rubles. (RUB 12,130 / 31 days);

(taking into account regional salary coefficients, if they are established);

The cost of living for the second quarter of 2021 is 12,130 rubles. (Order of the Ministry of Labor dated 08/09/2021 No. 561). Consequently, the new minimum wage for 2021 is 12,130 rubles. If the legislation regarding the establishment of the federal minimum wage does not change by the end of 2021, then it will be possible to focus on the specified amount.

Minimum wage in 2021 from January 1

The federal minimum wage operates throughout Russia. At the same time, many regions regularly set their own minimum wage, which is valid only in the territory of a specific constituent entity of the Russian Federation. It can be set immediately for a year or a quarter. In this consultation, we will not present the minimum wage by region in a separate table, since you can always look at this indicator on the main page of our website. In the right column at the top, select your region and the screen will display the current minimum wage in your region for the current date. And in the “History” tab you can see the history of changes in minimum wage rates in your region.

For 2021, the rule of maintaining the minimum wage will not apply due to the fact that the cost of living based on the results of the 2nd quarter of 2021 is higher than calculated for the 2nd quarter of 2021. It is equal to 12,130 rubles. (Order of the Ministry of Labor of Russia dated 08/09/2021 No. 561n). That is, the federal minimum wage in 2021 will increase by 850 rubles compared to what was in effect in 2021 (RUB 11,280). — up to 12,130 rub .

In accordance with the current rules for establishing the federal minimum wage, its value is determined annually as of the beginning of the coming year, with a guide to the cost of living for the population capable of working for the 2nd quarter of the ending year. An increase in the cost of living leads to an increase in the minimum wage, but a decrease does not serve as a basis for reducing the minimum wage.

What procedure is used to establish the minimum wage for 2021?

For subsequent years, this compliance begins to apply on January 1, but may not always be fulfilled, since if the cost of living decreases in the year taken as a guideline in comparison with the previous year, the minimum wage is not subject to reduction (Article 1 of Law No. 82-FZ) . In such a situation, its value is determined by the cost of living, calculated for the 2nd quarter of the year preceding the previous one (or several previous ones, if the cost of living has been steadily declining over several years).
