The minimum wage was equated to the flow minimum earlier than planned

At the very end of 2021, Federal Law No. 421-FZ dated December 28, 2017 was adopted. They recorded that from January 1, 2018, the minimum wage will increase to 9,489 rubles per month. Moreover, starting from January 1, 2021 and thereafter annually from January 1 of the corresponding year, the minimum wage is established by federal law in the amount of the subsistence level of the working-age population as a whole in the Russian Federation for the second quarter of the previous year. In other words, starting in 2021, a mechanism has been introduced to bring the minimum wage to the subsistence level of the working population.

By Decree of the Government of the Russian Federation dated September 19, 2017 No. 1119, the cost of living for the working population is 11,163 rubles. Thus, one could expect that the minimum wage of 11,163 rubles would be established from January 1, 2021. However, the situation changed dramatically after V.V.’s statement. Putin. During a working trip to the Tver region, Vladimir Putin promised: the minimum wage in Russia will be equal to the subsistence level from May 1, 2018.

Thus, bringing the minimum wage to the subsistence level of the working-age population occurred earlier than planned - from May 1, 2018. The corresponding law has already been prepared and is awaiting submission to the State Duma.

The subsistence minimum is the cost of a conditional consumer basket, which includes a minimum set of food products, non-food products and services that are necessary to ensure human life. The cost of living also includes mandatory payments and fees.

The cost of living is approved at the end of each quarter, using numerous statistical data, including the inflation rate, to determine it. The federal subsistence minimum is set by the Government of Russia, and regional minimums are set by regional governments.

But what will the increase in the minimum wage from May 1, 2021 affect? What actions will employers need to take in connection with the increase in the minimum wage? We'll talk about this further.

New minimum wage and salary from May 1, 2021

The minimum wage is the minimum wage that an organization or individual entrepreneur (employer) must accrue to employees for the month they have fully worked (Article 133 of the Labor Code of the Russian Federation). However, keep in mind that an employee may receive less than the minimum wage in person - minus personal income tax and other deductions, for example, alimony. Accordingly, from May 1, 2018, it is impossible to pay less than 11,163 rubles.

It is worth noting that the salary of employees from May 1, 2021 may be less than 11,163 rubles. After all, the total salary, which includes (Article 129 of the Labor Code of the Russian Federation) cannot be less than the minimum wage:

  • remuneration for work;
  • compensation payments, including additional payments and allowances;
  • incentive payments (bonuses).

The total amount of all such payments from May 1, 2021 must be at least 11,163 rubles.

If, from May 1, 2021, the employee’s salary is less than the minimum wage (11,163 rubles), then the employer may be held accountable in the form of fines. The fine for an organization can range from 30,000 to 50,000 rubles, and if detected again - from 50,000 to 70,000 rubles. For a director or chief accountant, the liability may be as follows: for a primary violation, they may issue a warning or a fine of 1,000 to 5,000 rubles, for a repeated violation, a fine of 10,000 to 20,000 rubles. Moreover, they can be disqualified for a period of one to three years (Article 5.27 of the Code of Administrative Offenses of the Russian Federation).

Minimum wage in the regions from May 1, 2021

From May 1, 2021, regional authorities can establish in a special agreement their own minimum wage, which exceeds the federal minimum wage (Article 133.1 of the Labor Code of the Russian Federation). However, the regional minimum wage can be abandoned. For these purposes, you will need to issue a reasoned refusal and send it to the local branch of the Committee on Labor and Employment.

In accordance with Part 1 of Art. 133.1 of the Labor Code of the Russian Federation in a constituent entity of the Russian Federation, a regional agreement may establish a different minimum wage. It should not be lower than the minimum wage approved by federal law. That is, from May 1, 2021 - no less than 11,163 rubles (Part 4 of Article 133.1 of the Labor Code of the Russian Federation). Employers are considered to have acceded to the regional agreement on the minimum wage if, within 30 calendar days from the date of its publication, they have not sent a written reasoned refusal to join it to the Ministry of Labor of Russia. In this case, the organization is obliged to comply with all provisions of the regional agreement (Part 8 of Article 133.1 of the Labor Code of the Russian Federation). This means that the minimum wage established by the regional agreement is mandatory for the employer.

The Federation of Trade Unions of the Krasnoyarsk Territory held negotiations with social partners to conclude a Regional Agreement on the minimum wage in the Krasnoyarsk Territory for 2021.

During the negotiations, the Federation of Trade Unions of the Territory proposed to establish a minimum wage in the territories of the region equal to the minimum wage (minimum wage) established at the federal level from January 1, 2021 (9,489 rubles) multiplied by the regional coefficient and percentage bonuses. Thus, for example, in the central and southern regions the minimum wage would be 15,182 rubles. The regional government calculated that to implement an agreement with such parameters it would be necessary to allocate an additional 6.1 billion rubles from the budget. and proposed their own parameters for the minimum wage. For the calculation, figures were taken from the Regional Agreement on MW in force in 2021, indexed by 4%. Regional organizations of the public sector trade union (health care, government institutions, education, culture) made their own adjustments and proposed making an exception for the central and southern regions of the region and instead of 11,016 rubles. (10,592 rubles * by 4%) to set the minimum wage at the level of the subsistence level of the second quarter in Russia (11,163 rubles). A draft regional agreement with these parameters was sent to the regional government for approval.

However, the decision of the Constitutional Court of the Russian Federation determined that the minimum wage (minimum wage in a constituent entity of the Russian Federation) does not include the regional coefficient and the percentage increase in wages. Thus, the minimum wage established at the federal level (from January 1, 2018 – 9,489 rubles) must be subject to a regional coefficient and a percentage increase. For example, in the central and southern regions of the region this value will be 15,182 rubles. And in the northern regions of the region this value will be greater.

It was precisely with these parameters that the FPKK initially entered into negotiations. Due to the fact that the regional government and regional employers' associations did not support the trade unions' proposal, the Federation of Trade Unions of the Krasnoyarsk Territory decided that it was impossible to conclude a Regional Agreement in parameters that do not meet the ruling of the Constitutional Court of the Russian Federation. Minimum wage from May 1, 2021 in Moscow and the Moscow region

From May 1, 2018, the minimum wage for the city of Moscow will not change. Its current size is 18,742 rubles. This is explained by the fact that the cost of living in the 3rd quarter of 2021 became lower than in the 2nd quarter. Therefore, they left the minimum wage at the same level. In St. Petersburg, the minimum wage is 17,000 rubles, for a 1st category worker it is no less than 13,500 rubles. This is higher than the subsistence level for the working population for the 3rd quarter of 2021 - 11,868.20 rubles. In the Leningrad region, the minimum wage is less - 11,400 rubles, but also higher than the subsistence minimum for the working population in this region - 10,147 rubles. Apparently these values ​​will not change from May 1. However, regional authorities can accept a new agreement at any time. The exact minimum wage will be known closer to May 1.

Dynamics and size of the minimum wage in Kemerovo and the region

In accordance with the Agreement mentioned above, in the Kemerovo region in 2021, the size of the minimum wage is set depending on the sources of financing of the employing organization.

For all commercial structures of the Kemerovo region (this applies to both private and state enterprises, as well as entrepreneurs), in 2021 there will be a minimum wage of at least 1.5 times the subsistence level for the working population of the region for the 2nd quarter of 2020. Consequently, the minimum wage for commercial enterprises in the Kemerovo region for 2021 is 22,140 rubles.

As for structures financed from the budget, in the Kemerovo region they have an all-Russian value of 12,792 rubles.

How is the indicator calculated?

The all-Russian minimum wage indicator in 2021 was raised to 12,792 rubles (the previous value was 12,130 rubles). But local authorities may revise the “minimum wage” upward. The specifics of the region are taken into account: inflation, cost of living, climate, etc. The main requirement: the regional minimum wage indicator cannot be less than the national average, and it must be adopted on the basis of an agreement between local authorities, trade unions and employers.

The Kemerovo region is one of the federal subjects that took advantage of this opportunity. The size of the minimum wage here is determined by Agreement No. 1, which was signed on January 17, 2019 by representatives:

  • Kemerovo regional trade union organization;
  • local authorities represented by the Board of Administration of the Kemerovo Region;
  • associations of employers in the region.

This document is valid for 2019-2021.
