We deduct expenses for self-employed services from the tax base

A company can reduce the tax payable by the amount of expenses for the services of a self-employed person only in one case - if it has a check from the self-employed person. In the interaction between a legal entity/individual entrepreneur and a self-employed person, the check essentially plays the role of a certificate of work performed. Therefore, the company can take it into account.

Nevertheless, many specific questions arise on the topic of the check. The tax authorities have already answered most of them:

  • Is it possible for a company to take into account expenses not on the basis of checks from self-employed people, but on the basis of acts at the end of the month?

Referring to parts 8 - 10 of Art. 15 of Federal Law No. 422-FZ of November 27, 2018, the Federal Tax Service unequivocally answers that the presence of checks is mandatory - without them it is impossible to take into account the amounts paid to the taxpayer when determining the tax base. This does not exclude the possibility of drawing up an act in which the period or date of service provision is indicated, which also affects the reflection of expenses in tax accounting. However, the deed itself is only an addition to the check.

  • Are receipts required to be printed?

It is not necessary to print it out, just as you can store the receipt in any convenient form - paper or electronic.

An electronic check has the same power as a paper check. It contains similar information, in particular, a unique identification number assigned by the Federal Tax Service. You can check the receipt using this number (Parts 4 - 6 of Article 14 of the Federal Law of November 27, 2018 No. 422-FZ).

  • What is the deadline for transferring a check from a self-employed person and what are the consequences of not transferring it?

According to Part 3 of Art. 14 of Federal Law No. 422-FZ of November 27, 2018, the transfer of the check occurs at the time of settlement, if this settlement is made in cash or using electronic means of payment.

But there are other forms of calculation. In such cases, the check must be delivered before the 9th day of the month following the one in which the payment was made.

If an intermediary is involved in the interaction between a self-employed person and a legal entity, then it is he who is responsible for generating the check. In this case, the intermediary must have the obligation to use cash register equipment.

Since in Part 1 of Art. 14 of Federal Law No. 422-FZ of November 27, 2018 stipulates the obligation of a self-employed person to transfer a check to the customer, then ignoring this obligation may lead to the customer notifying the Federal Tax Service of a violation. It must be remembered that only the presence of a check allows the company to deduct expenses for self-employed services from the tax base. Therefore, she is very interested in ensuring that the transfer of checks occurs smoothly.

  • What if a self-employed person had to return the money and cancel the check?

The Federal Tax Service points out that in this case the company will also have to cancel the check. She will also need to make changes to the amounts of expenses taken into account when calculating the tax base. The adjustment procedure depends on the tax regime that the company applies.

What are the benefits of working with self-employed people?

When a company works with an individual, for example, under a GPC agreement or under an employment contract, it pays personal income tax for him in the amount of 13% plus charges insurance premiums on his remuneration. When collaborating with an officially registered self-employed person, there is no need to pay company tax for him - this responsibility falls on the self-employed person himself. The tax will be 6% of each transaction with a legal entity.

Some companies, sensing this benefit, began to think about “transferring” their employees to self-employed status. But the Ministry of Finance in one of its letters (Letter of the Ministry of Finance of the Russian Federation dated 02/01/2019 N 03-11-11/5884) explained that such re-registration is impossible. Federal Law No. 422-FZ dated November 27, 2018 does not prohibit the use of a special regime for self-employed individuals who have entered into an employment contract with a legal entity. However, there is one condition: this legal entity should not be the customer of services or work under the GPC agreement for these individuals and should not be their employer less than two years ago. That is, a legal entity can work with a self-employed person who is its former employee, but provided that at least two years have passed since the latter’s dismissal.

Thus, it will not be possible to fire workers and enter into GPC agreements with them in the future as self-employed in order to save on paying contributions and personal income tax.

The self-employed person exceeded the income limit and lost his status. What should a legal entity do?

Among all other features, NPA has an important limitation on the income limit. A self-employed person can enjoy all the privileges and concessions until his annual income exceeds 2.4 million rubles. or 200,000 rub. per month. Therefore, experts recommend applying the NAP to those who are confident that their income will not “go beyond” this amount. If a self-employed person exceeds the established income limit, he automatically loses the right to apply NPA from the date of excess.
