In order to prevent or at least make less aggressive the impact of harmful production factors on the worker’s body, personal protective equipment is used. Such equipment includes protective clothing and safety footwear, means to reduce the negative impact on the respiratory system (for example, a respirator), eye protection items (for example, safety glasses) and more. Specific personal protective equipment for workers of different professions is determined by standard standards established by the Ministry of Health and Social Development of Russia or the Ministry of Labor of Russia.

The employer provides the issuance of special clothing at his own expense; in addition, their storage and, if necessary, repair and replacement must be ensured. If the performance of a certain job requires the use of protective clothing, shoes, or other equipment, then the employer does not have the right to allow the employee to perform work duties without protective equipment.

Personal record card for the issue of workwear

The fact that protective equipment was issued to an employee must be recorded in documents. This document is a personal record card for the issuance of personal protective equipment in the form approved. by order of the Ministry of Health and Social Development of Russia No. 290n dated June 1, 2009. It must indicate the issuance and return of personal protective equipment.

Previously, the issuance and return of workwear, safety footwear and other items to protect the health of the employee were reflected in personal cards in form No. MB-6, but currently this form is not used.

Personal registration cards for the issue of workwear, who maintains these documents? Personal cards for recording the issuance of personal protective equipment are kept by the employer or by an authorized official who is responsible for their maintenance. You should not assign the responsibility for maintaining cards to a labor protection specialist, since his responsibilities include monitoring their correct completion.

The card is double-sided. The front side of the card contains complete information about the employee: full name, personnel number, department where the employee works, the position he holds, the date the employee started working and the date of change of position, if any.

Then information about the external data and dimensions of the employee is indicated: his gender, height, size of clothes, shoes and headgear, gas mask, respirator, mittens and gloves. Under the employee’s data, the basis on which he is to be issued special clothing is indicated.

Next, the personal card for issuing workwear (you can see a sample of the form below) contains a table that lists:

  • Name of the remedy;
  • Model norms clause;
  • Unit in which protective equipment is measured (for example, a pair, if we are talking about gloves or mittens, or pieces):
  • The number of protective equipment provided for issue to an employee per year.

The reverse side of the card contains a more voluminous table, which consists of 11 columns:

  • Name of personal protective equipment;
  • Certificate number, which indicates its compliance;
  • Date when the product was issued;
  • Number of items issued;
  • Percentage of wear of protective equipment;
  • Signature of the employee who received the protective equipment;
  • Date when the product was returned;
  • Number of items returned;
  • Wear percentage;
  • Signature of the employee who handed over the personal protective equipment;
  • Signature of the employee who accepted the personal protective equipment.

Nuances of drawing up a document at an enterprise

Current legislation assumes that the employer has the right to fill out cards both manually and using software. In the second case, their structure must correspond 100% to the standard structure approved by the Ministry of Health and Social Development. Instead of the “live” signature of the employee who took the valuables, it contains the date and number of the primary document drawn up by the accountant at the time of issuing the PPE, which contains the “physical” visa of the hired specialist.

The employer can organize the issuance of protective equipment using vending machines that do not require the physical participation of storekeepers or other authorized persons. In this case, the employee who received each item must be personalized. Automating the process does not relieve the company from the need to fill out cards. The hiring company independently determines the person who will be responsible for maintaining documents. The position and full name of the authorized employee is fixed by its local acts. As a rule, this role is played by:

  • storekeeper;
  • Warehouse Manager;
  • shop manager, etc.

Registration of a personal registration card for the issue of workwear

Personal registration cards for the issuance of workwear, footwear, and personal protective equipment (PPE) are issued according to the approved form No. MB-6. This document records the protective clothing, safety footwear and protective equipment issued to employees according to the established norm for personal use. The card is issued in one copy for each employee who is issued special clothing. In the document, fill out the lines “Name”, “Personnel number”, “Height”, “Gender”, “Size of clothing, shoes, headgear”, “Site”, “Workshop”, “Profession”, “Date of employment”. Then you need to fill out the columns “Name of workwear, safety footwear and protective equipment”, “Paragraph of standards”, “Unit of measurement”, “Service life”, “Quantity”.

On the reverse side of the “Personal Card” the sign “Issue and return of workwear, safety footwear and protective equipment” is filled out. It indicates the name and item number of the issued protective clothing; in the “Issued” subsection the date, quantity, percentage of validity, cost and signature of the employee on receipt are indicated. In case of loss of protective clothing, footwear or protective equipment, in the “Returned” section, in the line of the lost item, the disposal certificate, its number and date are indicated. The issuance of duty clothing is issued on separate cards marked “Duty”. The card must be signed by a safety engineer, workshop manager, or accountant. The document must be kept by the storekeeper of the workshop (site). It is allowed to maintain workwear cards in electronic form using computer programs.

Who should issue registration cards for the issue of workwear?

The procedure for providing workers with workwear, as well as the procedure for storing, replacing, repairing, washing, drying it, including the procedure for issuing personal cards for registering the issue of workwear, the employer must determine by local regulations (regulations, orders, organizational standards). In this case, it is necessary to take into account the distance of the units from the central warehouse. The employer may assign the responsibility for issuing personal PPE registration cards to the site manager, warehouse manager or other materially responsible employees. It is not allowed to assign responsibilities for maintaining workwear accounting cards to a labor protection engineer, since in accordance with his job responsibilities he must control the correctness of maintaining these documents (clause 7.23 of the Appendix to the Resolution of the Ministry of Labor of Russia dated 02/08/2000 N14).

Storage periods for completed cards and responsibility

In the lists of the Ministry of Culture No. 558 dated August 25, 2010, on the basis of which the storage periods for archival documents at the enterprise are determined, the card for issuing PPE is not mentioned. It follows from established legal practice that hiring companies need to focus on the period of storage of lists for the issuance of protective equipment. It is equal to one calendar year.

If an employer evades the obligation to fill out cards or does not keep them in the archive for a year, administrative measures will be applied to him. According to the provisions of 5.27 of the Code of Administrative Offenses of the Russian Federation, the fine will be:

  1. 1-5 thousand rubles. – for the head of a company or individual entrepreneur;
  2. 30-50 thousand rubles. – for a legal entity.

If a violation of labor legislation is detected again, the amount of penalties increases. Individuals and individual entrepreneurs pay up to 20 thousand rubles to the budget, companies – up to 70 thousand rubles. An additional measure of liability for managers is their administrative disqualification (deprivation of the right to hold certain positions) for a period of 1-3 years.

Answer: The employer, at its own expense, is obliged, in accordance with established standards, to ensure the timely issuance of work clothes, safety shoes and other personal protective equipment to employees, as well as their storage, washing, drying, repair and replacement (Article 221 of the Labor Code of the Russian Federation).

Intersectoral rules for providing workers with special clothing, special shoes and other personal protective equipment (Order of the Ministry of Health and Social Development of Russia dated June 1, 2009 N 290n, as amended on January 27, 2010 N 28n) establish mandatory requirements for their acquisition, issuance, use, storage and care.

The procedure for providing workers with work clothes, safety shoes and other personal protective equipment, as well as the procedure for storing, washing, drying, repairing and replacing them, including procedures for preparing accounting documents and personal cards for recording the issuance of personal protective equipment, is determined by the employer by its local regulatory legal act (order, regulation, organization standard ). In this case, it is necessary to take into account the distance of structural units from the central warehouse. The employer has the right to assign the responsibility for maintaining a personal record card for the issuance of personal protective equipment to the warehouse manager, site manager or other materially responsible officials.

It is not allowed to assign the responsibility for maintaining personal records of the issuance of personal protective equipment to a labor protection engineer, since according to his official duties he is obliged to monitor the correctness of their maintenance (clause 7.23 of the Appendix to the Resolution of the Ministry of Labor of Russia dated 02/08/2000 N 14).

In accordance with clause 30 of the Intersectoral Rules (as amended on January 27, 2010 N 28n), the employer, at his own expense, is obliged to provide care and storage of PPE, promptly carry out dry cleaning, washing, degassing, disinfection, neutralization, dust removal, drying of PPE, and repair and replacement of PPE. For these purposes, the employer has the right to issue employees with two sets of appropriate PPE with double the wearing period.

Employees are prohibited from taking PPE outside the employer’s territory at the end of the working day (clause 27 of the Rules and clause 15 of the Amendments). In some cases, when, due to working conditions, the specified procedure cannot be followed (for example, at logging sites, etc.), special clothing and other personal protective equipment remain with the workers.

Based on the results of certification of workplaces for working conditions, as well as taking into account the conditions and characteristics of the work performed, for the periodic performance of certain types of work not specified in the standard PPE standards, they are issued as duty PPE or with a “wear-out” period. For example, PPE for respiratory organs, a helmet, a safety belt (restraining harness), dielectric gloves and galoshes, safety glasses and shields, headphones, etc. Duty PPE for general use is issued to employees only for the duration of the work for which they are intended.

Rules for providing personnel with protective equipment

In Art. 221 of the Labor Code of the Russian Federation states that employing companies must provide employees with equipment and tools that protect their health if the production meets the following criteria:

  • found to be harmful or dangerous based on the results of a special assessment;
  • differs in exposure of workers to high temperatures or pollution.

Each industry sector has its own standards for providing personnel with PPE. They are recorded in sectoral orders of the Ministry of Labor and the Ministry of Health and Social Development. These regulations specify how many items are issued to each employee per year. The company has the right to increase these values ​​by enshrining new standards in local regulations. Their reduction is not permitted by current legislation.
