Help-call for session 2021: who needs it and why

The form of the summons certificate was approved on December 19, 2013 by order of the Ministry of Education and Science of Russia No. 1368. It is issued to students combining work with study at higher educational institutions to ensure the guarantees provided for in Article 173 of the Labor Code.

In accordance with this norm of the Labor Code, bachelors, masters and specialists studying part-time (part-time) have the right to take additional paid leave:

  • for 40 days – upon passing the session in the 1st and 2nd courses;
  • for 50 days – upon passing the session in subsequent courses.

If a student worker undergoes training in a shortened period, already in the 2nd year he can take a 50-day leave with pay. If an employee faces final certification before receiving a diploma, the maximum vacation time increases to four months.

To take advantage of such preferences, you must study at an educational institution that has state accreditation. The dean's office of the university issues him a certificate of invitation to the session, which he submits to the employer along with an application for study leave.

Full-time students will also need the same certificate if they find time to officially work somewhere. They are also given study leave, but only at their own expense: up to 15 days per academic year for intermediate sessions, and up to 4 months for defending their diploma and passing state exams.

Article 173 of the Labor Code sets out the maximum possible periods for students' educational leaves, depending on the form of study and other circumstances. However, the duration of leave for a particular employee will correspond to the session period specified in the certificate. That is, in reality it may be less than the period specified in the law (but not more!).

Having received a certificate and application from the student-worker, the employer is obliged to provide him with additional study leave. He issues a corresponding order, which indicates the duration of the vacation, as well as whether it is paid or not. The employee is introduced to this document against signature. If an employee studies by correspondence in another city, the employer pays for his travel to and from the place of study once a year.

How is study leave paid?

Study and annual leave are calculated according to the same rules. However, there are a number of differences:

  • Study leave (or part of it), unlike annual leave, cannot be replaced with monetary compensation. This is not provided for by the Labor Code;
  • Study leave is not extended for non-working holidays that fall on it. But you need to pay for them;
  • If an employee falls ill during study leave, he is not entitled to temporary disability benefits for days of illness falling on vacation, and study leave is not extended during the illness.

According to the developed form, the call certificate must contain:

  • date of its compilation and number;
  • name of the employing organization (or individual entrepreneur);
  • a link to the relevant article of the Labor Code (if we are talking about a university student - Article 173 of the Labor Code);
  • in what form the student is studying at the university, in what course;
  • what event is planned (interim certification, final certification, etc.);
  • in what terms (start and end dates, as well as the number of days are reported);
  • name of the higher educational institution;
  • information about its accreditation (number, series of certificate, who issued it, for what educational program, etc.);
  • Full name of the head of the university, or other authorized employee;
  • seal of the educational institution.

Receiving a document

A certificate of challenge to defend a thesis or to attend a session is issued by the dean’s office. It states:

  • student's place of work;
  • his first name, patronymic, last name;
  • information about the form of training and course;
  • for what purpose was the challenge made (passing a session, preparing to defend a thesis, etc.);
  • call validity period;
  • full name of the university.

When the document is completed, it should be submitted to the employer along with the application request for study leave. At the same time, such leave is not only paid, but also the average earnings are preserved. The payment is made in the same way as if you were going on a planned vacation - all forced time off is paid in advance.

Periods of student absence from work:

  • session completion – 1 month;
  • state exams – 3-4 months;
  • writing and defending a thesis – 2-4 months.

A challenge certificate for a thesis in Moscow is issued for a maximum period, but you can use it partially. You must indicate a more precise time of your absence from work in your application.

According to the law, the employer, in the presence of such a summons certificate and application, has no right to refuse permission for study leave.

If a student is studying at two higher educational institutions at the same time, there is no point in taking certificates from both universities. He will be able to use the right to study leave only in relation to one of them of his choice.

The summons certificate also has a detachable part, which the student employee presents to the employer upon returning from study leave to confirm that he actually studied. It indicates the student’s data, the name of the university and the period of study. All this is confirmed by the signature of an authorized person and the seal of the educational institution.

Teaching a part-time student: what do you need to know?

“Students live happily from session to session.” This is a well-known saying that each student interprets differently. Some people have to go to the university every day, fruitfully preparing for the upcoming session.

For others, it is enough to appear for exams and then disappear again for several months. These are correspondence students who spend more time at work and only sit down with textbooks from time to time.

Correspondence education has its advantages and disadvantages, but it is recommended to start your conversation with the positive aspects.

Advantages of the correspondence form:

• the student receives a full-fledged higher education;

• it is not required to attend a university every day for 5 years;

• you can study and work at the same time to obtain the status of a financially independent person;

• teachers are more loyal to working students;

• after passing the exam, you may not attend the university for 3-4 months.

However, not everything is so smooth and cloudless; there are tangible (including financial) disadvantages of choosing correspondence education, which are important to know about before deciding on the form of acquiring knowledge for the next 5 years.

Disadvantages of the correspondence form:

• will have to study a year longer than full-time students;

• the correspondence department provides its services exclusively on a paid basis;

• you will have to acquire most of the knowledge yourself;

• a working student does not have much time to study at home;

• to obtain high-quality knowledge, you will have to work hard.

So the final choice is up to the applicant. If this is a correspondence department, it’s time to figure out in detail how to competently combine study and work, so that “it’s advisable to kill both birds with one stone.”

It is important, without conflicting with the employer, to regularly leave for a paid session, and at the university to take the appropriate documents about passing the next session - also to find compromises. To avoid problems, it is important to study what the law says about this.

Important nuances

We should not forget about the features of educational leave:

  1. If an illness occurs during student leave, its duration does not increase. After all, it is intended for specific purposes and for a specific time period indicated in the summons certificate. Thus, no benefits are paid for temporary disability during study leave. When a subordinate continues to be ill after completing additional leave, benefits are assigned from the next day on which the student leave was completed.
  2. Apprentice guarantees are not reduced due to the production needs of the enterprise. The employer cannot reduce the leave indicated in the certificate of the educational institution. An exception is the personal desire of the employee, expressed in a written request to reduce vacation. The head of the organization cannot deny additional days off to his specialist (if there is a summons certificate).
  3. The subordinate does not recall from student leave. Otherwise, the duration of the rest changes.
  4. Replacing rest time with monetary compensation is unacceptable. This contradicts the purpose of the guarantee.

The summons certificate is a mandatory and basic document that allows an employee to apply for student days off.

You can declare your right only if the document is properly executed using an up-to-date form with all fields filled out completely.

It is recommended to submit the certificate to the employer in advance so that he has time to prepare for the employee’s absence, complete the necessary documentation and pay for vacation days for study.

Purpose of the form

The summons certificate allows you to confirm your right to a weekend to take a session, state exams, diploma or dissertation work.

Also, a certificate issued in accordance with all standards indicates the success of the educational process.

This form serves as the main document on the basis of which all other documentation related to the registration of study leave is drawn up.

Important! Failure to call does not give the employee the opportunity to apply for time off for study, and therefore should promptly contact the dean’s office of the educational institution to obtain it.

When to receive a call

There are several circumstances when you need to buy a certificate-call for a session:

  • if you have academic debts, the document will not be issued;
  • you need more time to prepare for the session, state exams, and defense of your diploma than the call certificate allows;
  • For personal reasons, you need to take an unscheduled vacation or work because a profitable temporary job has turned up. It is necessary to take into account that it will not be possible to restore strength after defending your diploma or passing the exam - the law prohibits going on paid leave immediately after completing your study leave.

Is there a payment?

This depends on the form of training and the success of the session. Student leave is paid:

  1. "evening parties";
  2. “correspondence students”;
  3. graduate students.

The training is considered successful if the session is completed on time. Vacation pay is issued in the amount of average earnings. To calculate them, you need:

  1. Determine how much the employee earned over the previous year.
  2. Divide this amount by 12 (according to the number of months in the year).
  3. And then at 29.3 - this is the average number of days in a month.
  4. Multiply the resulting quotient by the number of days.

Vacation pay is issued no later than three days in .

Registration process

Study leave is granted on application and the student employee needs to know how to write it correctly. The application is accompanied by a summons certificate, which is issued by the educational institution. The specific period within which the employee must inform the organization about the vacation is not specified in the Labor Code.

Then a leave order is issued. If necessary, vacation pay is calculated and paid. Entries are made in the employee’s personal card, as well as in the working time sheet. And after completion, the employee must submit a confirmation certificate.
