How to count vacation days for January if some of them fall on the New Year holidays?

According to Article 120 of the Labor Code of the Russian Federation, official holidays are not included in vacation and are not paid. Moreover, it does not matter what schedule the employee works. Legislative regulation

The Labor Code of the Russian Federation clearly states whether holidays are included in vacation or not and whether they are paid, and whether it is even possible to take vacation on holidays.

An employee planning to go on vacation must find out whether there will be any days officially recognized as holidays during this period. If there are any, it should be taken into account that they are not included in the general vacation . But you shouldn’t expect payment during this time. An example of calculating vacation pay in January 2021

The employee goes on vacation from 01/01/2018 to 01/11/2019.
His average earnings for calculating vacation pay are 1,600 rubles. His salary is 47,000 rubles. There are 31 days in January, of which 17 are working days, and 14 are weekends and holidays.

The duration of vacation on the indicated dates is only 3 days (9, 10 and 11). This means that he will receive vacation pay of 1,600 * 3 = 4,800 rubles.

For comparison, if the vacation period is shifted by a month, i.e., take the same 11 calendar days, but from February 1 to 11, then the income will be completely different. Vacation pay will already amount to 1,600 * 11 = 17,600 rubles. The salary will be 47,000 / 19 * 12 = 29,684.21 rubles. And the total income for February, respectively, is 47,284.21 rubles.

How to calculate payment for days worked in January?

There are 17 working days in January 2021. Accordingly, to obtain the amount of wages for five-day workers, it is necessary to divide the salary amount by 17 and multiply by the number of days actually worked after leaving vacation.

As mentioned above, taking a vacation in mid-January is even more unprofitable than at the beginning. For example, you can again take a vacation period of 11 days, but from January 15 to 25. We will leave the rest of the conditions the same: average earnings 1,600 rubles. and salary 47,000 rubles.

Vacation pay will be 11 * 1,600 = 17,600 rubles. In this case, all vacation days are paid. But there are only 8 working days left. The salary will be 47,000 / 17 * 8 = 22,117.64 rubles. The entire income for January will be equal to 17,600 + 22,117.64 = 39,717.65 rubles. Compared to any of the above amounts, this income is the smallest. This is why taking a vacation in January is not recommended.

Employers are required to comply with labor laws, which oblige them, in particular, to provide all employees (including remote employees) with annual paid leave. The right to the first rest after employment at a company arises for an employee after six months of continuous work at the enterprise, unless the employer is ready to make a concession and let the subordinate go on vacation earlier. Accordingly, employees' vacation never begins on a holiday , since this period is not counted toward vacation pay.

Even if the application indicates that the employee is asking to be given leave from March 8, the official countdown of days will only start from 9.

The only exceptions to all these rules will be those workers who work in shifts. We are talking about security guards, cash collectors, sellers, cashiers, etc. For them, it does not matter whether it is a holiday or a day off, since the schedule provides for a completely different calculation of working time and its payment.

When is it profitable to take a vacation in 2021 based on money?

In the month during which vacation is taken, the employee’s payment consists of vacation pay and wages for days worked.

Vacation pay is calculated based on calendar days, not working days. The average daily income of an employee when calculating vacation pay is determined based on the average monthly number of days in a month (fixed value - 29.3). That is, despite the fact that the maximum possible number of working days in a month is 23, the average monthly number of days, 29.3, turns out to be significantly greater. This means that in any month, provided you receive the same salary, vacation payments will be equal.

But payments for part of the salary for the time worked during the month will be greater, the greater the number of days worked in the month in question.

Now let's look at the salary. Wages for days worked are calculated by dividing the salary by the number of working days in a month and multiplying the result of the quotient by the number of days actually worked. January, February and May have the fewest working days due to holidays (January, May) and the number of calendar days (February), and therefore in these months each working day costs more than in other months.

Accordingly, in months with 31 calendar days and no holidays, weekdays are the cheapest.

Let's demonstrate this statement with an example. Let the employee’s salary be 25,000 rubles. Then in August (despite the fact that this month has 23 working days - the maximum possible number of working days) a working day will be valued at 1086.95 rubles. And in January, due to holidays, there are few working days - only 18. Accordingly, one working day in January costs 1388.88 rubles.

The number of working days and days off varies from year to year and this should be taken into account when choosing the timing of your holiday.

Conclusion - in terms of money, the most profitable option is to book a vacation in the month that has the fewest holidays and weekends, but the most working days. As for the duration of vacation, if an employee wants to rest as long as possible, he should take vacation during which there are non-working holidays - such days will not be taken into account when calculating vacation pay, but the duration of vacation will increase due to holidays that coincide with it.

Example 1 - Vacation is issued in July (when it is profitable to take vacation in 2021)

Example 2 - Vacation in May does not include public holidays

The employee, according to the vacation schedule, will go on vacation from May 15 for 14 calendar days. An employee receives 50,000 rubles monthly. The billing period was fully worked out (from 05/01/2017 to 04/30/2018). During the billing period, a total of 600,000 rubles were earned (RUB 50,000 x 12 months).

Average daily earnings will be: (RUB 600,000: 12 months: 29.3 days) = RUB 1,706.48.

Vacation pay will be paid in the amount of: (1706.48 x 14 days) = 23890.72 rubles.

Salaries in May will be paid for 10 working days (there are 20 working days in May): (50,000 rubles: 20 days x 10 days) = 25,000 rubles.

For the month of May, the employee will receive a total of: (23,890.72 rubles + 25,000 rubles) = 48,890.72 rubles.

Example 3 - Vacation in May coincided with holidays

The employee, according to the vacation schedule, will go on vacation from May 1 for 14 calendar days. An employee receives 50,000 rubles monthly. The billing period was fully worked out (from 05/01/2017 to 04/30/2018). During the billing period, a total of 600,000 rubles were earned (RUB 50,000 x 12 months).

Average daily earnings will be: (RUB 600,000: 12 months: 29.3 days) = RUB 1,706.48.

During the vacation, 2 holidays are celebrated (May 1 and May 9), and therefore not 14 calendar days will be paid, but only 12 days of vacation, because Holidays are not included in the calculation of vacation pay. But the vacation will be increased by 2 days due to holidays, and therefore the next working day is May 17.

Vacation pay will be paid in the amount of: (1706.48 x 12 days) = 20477.76 rubles.

Salaries in May will be paid for 11 working days (total working days in May 20): (50,000 rubles: 20 days x 11 days) = 27,500 rubles.

For the month of May, the employee will receive a total of: (27,500 rubles + 20,477.76 rubles) = 47,977.76 rubles.

That is, vacation pay must be recognized at a time, since in accordance with Part 9 of Article 136 of the Labor Code, no later than three days before the start of the vacation, vacation pay must be transferred to the employee.
